The timing for the entry into force of the new Fertilizers’ regulation, which also includes biostimulant products, is expected in the 2020-2021 biennium.

At the beginning of 2018, the European Commission and the Council have been started negotiations to reach an agreenment on the final text published in draft version in March 2016.

Once unequivocally set the definition of biostimulant, which cleary defines the boundary between biostimulants and other type of products such as plant protection product.  In this context, more than ever, the attention of all those who want to place Biostimulants on the market is focused on the tests to be carried out in support of the Efficacy claims and on how to design experimental designs that give unequivocal evidence of biostimulant activity. The demonstration of effectiveness is the key to distinguishing this type of products from all the others used in agriculture giving them an added value.

In this new regulation each issue should be addressed in order to facilitate the proper functioning of the market.

Every fertlizing product, including biostimulant, will be regulated in terms of environmental safety both at the level of constituent components (CMC: Component Material Categories) and at the formulation level (PFC: Product Function Categories).

In April 2017 an ad hoc Technical Commission CEN/TC 455 was created with the task of developing harmonized standards for the Biostimulants’ sector adddressing different issues as claims supporting, microorganisms positive list, analytical methods and many others.

There is a strong expectation that the conclusion of the negotiations will take place by the end of 2018 in order to avoid a legislative deadlock.

The approval and the entry into force of this regulation will make a strong contribution to more sustainable agriculture and the concept of a circular economy.
